If you’ve started browsing homes in Illinois, you’ve probably noticed something new: real estate agents are now required to have a signed Buyer Representation Agreement before we can legally represent you.
This isn’t busywork, and it’s not a sales tactic.It’s actually state law, and it was put in place to protect you, the consumer.
Here’s what it means — in simple, real-world terms.
What Is a Buyer Representation Agreement?
A Buyer Representation Agreement is a written contract that outlines how your real estate agent will represent you, what services are included, and what you can expect throughout the home-buying process.
Think of it like hiring any other professional — a hairstylist, attorney, or financial advisor.Before they work for you, you both sign something that explains:
What they’ll do
What you’ll pay (or NOT pay)
What responsibilities each of you has
Real estate representation now works the same way.
Why Illinois Requires It to Be Signed
Illinois updated its real estate laws to make things clearer and more transparent for buyers. The state wants homebuyers to understand:
Who represents them
What services they’re getting
How their agent is compensated
What protections they have throughout the transaction
A signed agreement ensures everyone is on the same page before you tour homes, submit offers, or negotiate one of the biggest purchases of your life.
This requirement comes from the Illinois Real Estate License Act (225 ILCS 454), which says brokerage agreements — including buyer agreements — must be in writing and signed.
